Verification of judicial records and behaviours that could reasonably be expected to jeopardize the students’ physical or psychological safety

In order to preserve the physical and psychological safety and integrity of all students, school staff undergo verifications. 

Verification of judicial records

All applications for a teaching licence or a licence renewal must be accompanied by a Declaration Concerning a Judicial Record. Persons holding a teaching licence must inform their employer and the Ministère de l’Éducation of any change in their judicial record within 10 days of being notified of the change.

It is the responsibility of employers to ensure that all school staff who are regularly in contact with their students do not have a judicial record relevant to their functions.

The purpose of the verification of judicial records is to ensure the physical and psychological safety and integrity of students while respecting the rights and freedoms of teachers.

Verification of behaviours that could reasonably be expected to jeopardize the students’ physical or psychological safety

In addition to the obligation of verifying judicial records, school service centres, school boards and private educational institutions have a duty to ensure that persons who would be required to work with or be in regular contact with minors or students with disabilities have not acted in a way that could reasonably be expected to jeopardize the students’ physical or psychological safety while performing their duties within a school service centre, school board, private educational institution or educational organization in Québec.

These verifications apply to all persons who work with or are in regular contact with minors or students with disabilities.

Inquiry Committee

A permanent inquiry committee was established to inquire and issue opinions on situations that may constitute serious misconduct in the exercise of teaching duties or acts that undermine the honour or dignity of the teaching profession. This committee, which acts independently and impartially, contributes to protecting students and maintaining public confidence in the teaching profession.

The committee members are:

  • Ms. Christina Igorov, lawyer and chair of the inquiry committee
  • Mr. Stéphane Bourassa, school principal
  • Mr. Enzo Diaferia, teacher
