Attestation of a request for health services or social services for a child without the other parent’s consent
This attestation allows you to request health services (including health care) or social services for your child without the other parent’s consent, due to a situation of sexual, spousal or family violence.
The Minister of Justice designates individuals to issue the attestation, who must be criminal and penal prosecuting attorneys working for the Directeur des poursuites criminelles et pénales, acting as public officers.
These public officers must attest that the services will benefit the child’s health and safety.
Both parents have parental authority. Both must therefore consent to the services provided for their child.
Although the parents exercise parental authority jointly, a parent acting alone may consent to services and is presumed to be acting the consent of the other parent.
You can request an attestation if, as a result of a violent situation:
you want your child to receive services and the other parent refuses;
it is not safe for you to ask for the other parent's consent.
Scope of the attestation
The attestation entitles the holder to obtain only the services designated by the Minister.
This is an exceptional measure. It does not replace the law governing the care required by a child's state of health, nor the powers of the Director of Youth Protection.
