Forms of will

The notarial will, the holograph will and the will made in the presence of witnesses are the three forms of wills recognized by Québec law.

Requirements

You must comply with the conditions of the form you have chosen, otherwise your will may be invalid.

Will made in the presence of witnesses

You can draw up the will yourself by hand or using a computer. You must declare that it is your will and sign it in the presence of two witnesses.

Notarial will

It is drawn up by a notary and made in the presence of a witness. It does not need to be probated and the original is kept by the notary.

Holograph will

It is the simplest form of will. It may consist of only a few lines and must be written and signed entirely by hand.
