Changing the composition of the parental union patrimony

You and your spouse can agree to add assets to the parental union patrimony. For example, you may decide that earnings registered in your pension plans during the union are part of the patrimony.

You can also agree with your spouse to exclude certain assets (vehicles, residence, etc.). To be valid, any exclusion must be made before a notary.

For example, Mary cannot decide on her own to remove certain items from the parental union patrimony. Her spouse, Benoit, has to agree, and their joint decision must be notarized.

Additions and exclusions

You can add or exclude assets from the parental union patrimony in your parental union agreement.

However, for the exclusion to remain valid in the event that you become parents of a new common child, it must be confirmed by notarial act within 90 days of the child’s birth or adoption.
