Legal framework for living kidney donation

Organ and tissue donation is governed by sections 19, 24 and 25 of the Civil Code. These provisions relate to consent to care not required by a person’s state of health and alienation of a part of a person’s body.

The Act to facilitate organ and tissue donation regulates administrative measures and procedures for organ and tissue donation.

The Act respecting labour standards protects the donor’s job. An employee has the right to be absent from work for up to 26 weeks over a 12-month period for organ donation.
