If you can prove that your personal contribution during your union enabled your spouse to enrich themself in goods or services, you may be able to claim a compensatory allowance following their death.

This may be the case, for example, if you worked regularly for a company without receiving a salary.

This service is payable either: 

  • in cash
  • by instalments
  • by granting rights in certain assets

You must apply to the liquidator of the succession within 12 months of your spouse's death.

You must also come to an agreement with heirs and legatees by particular title (people who receive property or amounts of money under a will) to establish the amount of the benefit. In the event of a disagreement, this amount will be determined by the court.
