Today, the Law to better protect vulnerable persons This hyperlink will open in a new window. enters into force and, with it, come several new measures that will make a meaningful difference in the lives of thousands of Quebecers.

This law updates the protection system for people in vulnerable situations so as to better meet their needs and those of their families. From now on, protection and support will be more adapted to each situation. The law will give greater value to the person's autonomy, while taking into account their wishes and preferences and protecting as much as possible the exercise of their rights, in addition to providing a better framework for the management of minors' patrimony.

What are the main changes?

  • With the simplification of protective measures, curatorship is abolished. The current curators will therefore become tutors.
  • The tutorship may be further modified based on the person's capacity to perform activities that they can do on their own.
  • The Protection mandate will be even safer with the addition of an inventory and rendering of accounts. This will provide the incapacitated person with greater protection from financial abuse.
  • The main measure of the law, the Assistance measure will allow a person living with a difficulty to receive help from one or two assistants they will have chosen themselves, to support them with their communications and dealings with various third parties (ministries, organizations, service providers and professionals).
  • Another important new feature, the Temporary representation, will make it possible to temporarily designate a person to perform a specific act on behalf of an incapacitated adult, thus avoiding instituting a tutorship.

The coming into force of the law and these changes coincides with the migration of the Curateur public's Web content to the Québec.ca government portal. Information on the organization's measures and services has now been integrated to the portal.

Many partners worked with the Curateur public to prepare for the coming into force of this important piece of legislation: the health and social services network, including the Collège des médecins and the Ordre des travailleurs sociaux et des thérapeutes conjugaux et familiaux du Québec; the Barreau du Québec; the Chambre des notaires du Québec; the Québec Chartered Professional Accountants order; organizations representing and defending the rights of individuals, as well as many other partners (ministries, organizations, representatives of the financial sector and the business community) who care about the rights of people in vulnerable situations.

The coming into force of the law is not only an opportunity to recognize the changes that are taking place, but also encouragement to pursue the efforts to improve the protection and support of those who need it. Together we can make a real difference.
