Rights of Victims of Crime

A victim of a crime is a person who has suffered physical or psychological injury or material loss as a result of a crime committed in Québec. 

Right to obtain information about an incarcerated person’s sentence

If you are a victim of a crime and the person who committed the crime is incarcerated in a Québec correctional facility, you have the right to obtain certain information regarding their sentence:

  • Date of eligibility for temporary release (excluding family visits) and the date such release is granted.
  • Date of eligibility for parole and date of parole granted.
  • Conditions of a temporary release or parole.
  • The destination of the incarcerated person during a temporary release.
  • Date of final release.
  • Any escape or unlawful release of the incarcerated person.

Victims of domestic violence, sexual assault, or an offence involving pedophilic behaviour will receive certain information without having to request it, provided that the contact information in the court record is up to date.

When a temporary release or parole is granted, Services correctionnels or the Commission québécoise des libérations conditionnelles must notify law enforcement agencies so that they are aware of the conditions the offender must comply with. 

Right to be heard before the granting of temporary release for reintegration purpose

If you are a victim of a crime and wish to provide information to Services correctionnels so that it may be taken into account during the assessment process prior to the granting or denial of a temporary release (e.g., description of the impact suffered, request for a no-contact order, etc.), you may complete the Written Representations and Request for Information Form (PDF 326 Kb).

Important: The information you provide in this form may be shared with the incarcerated person if they request it in writing, unless there is reasonable cause to believe that its disclosure would threaten your safety or that of another person.  

Victim Services Office

  • The Bureau des services aux victimes supports individuals whose aggressors are incarcerated in a correctional facility in Québec. This victim services office is staffed by specialized professionals who

    • review requests for information from victims.
    • disclose authorized information.
    • process written submissions regarding the granting of temporary release.
    • answer questions from victims and their advocates regarding the legal obligations of Services correctionnels with respect to victims via a toll-free helpline.
