Procedure to obtain an exclusive exploration right
The exclusive exploration right (EER), formerly known as a claim, is the only available exploration title in Québec.
This mining title gives the exclusive right to search for all mineral substances in the domain of the State. However, it does not affect the research or exploration of surface mineral substances except for silica sand.
Registration process
Québec is divided into grid portions that can be designated throughout the territory. The exclusive exploration right is obtained by map designation of one or more of these polygons.
To do so, you must submit a notice of designation through the GESTIM platform, which is the title management system.
Validity and renewal
The first term for an exclusive exploration right is three years.
The holder may renew for two-year terms through the GESTIM platform. However, the holder must meet the conditions set out in their mining title. For example, they must carry out exploration work in the land subject to the exclusive exploration right, the nature and amounts of which are determined by regulation.
Prospecting
Prospecting is the very first step in the mineral development process and requires no permits.
It involves trying to identify indications of mineral deposits in the territory. Due to the very superficial nature of the collection of rock samples available on the ground surface, this step has virtually no impact on the territory. However, this research must be conducted in accordance with laws and regulations, including those related to access to land and other land uses.
