Disclosure of medical information – Procreation involving a third person
If your birth resulted from a parental project involving gamete donation or surrogacy, your doctor may, if they deem your health warrants it, obtain medical information on the third party who contributed to your procreation (sperm donor, egg donor or surrogate mother).
If you are a gamete donor (sperm or egg donor) or a surrogate mother, your doctor may, if they deem your health warrants it, obtain medical information on the person born as a result of your contribution.
If you are a relative genetically linked to a person whose birth was the result of a parental project involving gamete donation or surrogate pregnancy, or to a sperm donor, an egg donor or a surrogate mother, your doctor may, if they deem your health warrants it, obtain medical information on that person as well as on the third party who contributed to the person’s procreation, as the case may be.
The person whose medical information is being requested must give their consent before it is released. However, if they refuse, an application can be filed with the court.
Steps for obtaining consent
To find out who to contact to obtain the medical information, your doctor must submit a request to the register of origin information maintained by the Ministère de l’Emploi et de la Solidarité sociale. The request must include a written declaration that your health justifies disclosing this information.
If the person can be found, they will be asked if they consent to their medical information being disclosed to your doctor. If they consent, the register will inform your doctor as to who the person is and how to contact them or their doctor.
The person’s identity will be kept anonymous at all times.
