Preparing a joint application for divorce on a draft agreement

Once you’ve collected all the information you need, you can file your joint application for divorce on a draft agreement. You and your spouse will need to:

  1. print out and complete the model forms;
  2. attach the required documents;
  3. file the application and documents with the office of the Superior Court in the judicial district where you or your former spouse live; and
  4. pay the court office fees, unless you can present a certificate of eligibility for legal aid.

Model forms

Print out the following forms found at the back of the brochure Joint Application for Divorce on Joint Agreement (PDF 0.92 Mb):

  • Draft agreement;
  • Joint application for divorce;
  • Backing sheet, which must be stapled to all the other documents, including the divorce application and the draft agreement.

You and your former spouse must complete the forms using your information and following the instructions in the brochure. You can ask a legal advisor for help if needed.

In some courthouses, you and your former spouse can each file a sworn statement instead of appearing before the court. If this is the case at your courthouse, you must both:

You must then attach the sworn statements to the rest of your joint application.

Required documents

You must include the following documents with your application:

  • copies of your birth certificates;
  • a copy of your marriage certificate;
  • a certified copy of your marriage contract, if applicable;
  • a certified copy of the judgment granting your legal separation, if applicable.

In some cases, you must also provide the court with various documents concerning your children, such as copies of their birth certificates.

Depending on your situation, other documents may also be required.
