Curateur public’s role in protection mandates
When a protection mandate is homologated, the Curateur public receives a copy of the judgment and is required to:
- inform the mandator and the mandatary of the rules that apply to them;
- maintain the register of homologated mandates in its Public register of representation measures.
The Curateur public can also:
- intervene in the homologation of the protection mandate by the court;
- receive and process reports about persons with a homologated protection mandate;
- may use its investigative powers to audit the mandatary’s administration in cases of suspected financial abuse or potential harm to the person or their property;
- ask the court to relieve the mandatary of their duties or to terminate the mandate and institute a tutorship.
