Requesting the administrative reconsideration of a decision by the Ministère de l'Emploi et de la Solidarité sociale

An administrative reconsideration applies to decisions made by the staff of the Ministère.

Step 1: Check eligibility

Various employment programs, measures or services may be open to an application for administrative reconsideration.

Public employment services: 

  • ineligibility for employment measures and services 
  • financial assistance for employment measures and services 
  • ineligibility for the Work integration contract measure or one of its components 
  • ineligibility, as an apprentice, for the Workplace Apprenticeship Program 
  • ineligibility for the Employment Retention Bonus 
  • ineligibility for the Programme de subventions aux entreprises adaptées 

Aim for Employment Program: 

  • financial assistance for activities included in the labour market entry plan  
  • obligation to participate in the Program 
  • labour market entry plan 
  • refusal of an application to participate in the Program 

Vocational qualification:  

  • trades requiring compulsory qualifications  
  • trades covered by interprovincial Red Seal standards 
  • qualification exam results 

Step 2: Obtain explanations on a decision made

You can ask for explanations on a decision that has been made.

Step 3: Respect the deadline for requesting an administrative reconsideration

For a written decision, the 30-calendar-day period begins on the date the decision is received.

For an unwritten decision, the 30-calendar-day period begins on the date you are notified of the decision.

Definition of calendar days and workdays

Calendar days include weekends and statutory Gouvernement du Québec holidays. A deadline falls on a holiday or weekend? It is then moved to the next working day. 

Workdays are counted from Monday up to and including Friday. Saturdays, Sundays and statutory Gouvernement du Québec holidays are not included.

Step 4: Complete the application for an administrative reconsideration

Use the application for an Administrative Reconsideration form (PDF 733 Kb) to make your request.

You have the right to be represented. Written confirmation is required. This confirmation must include the name and contact details of the person who will be representing you.

Step 5: Send the application for an administrative reconsideration

The way in which an application is transmitted varies. The application may be related to

  • employment assistance services 
  • the Aim for Employment Program 
  • to the vocational qualification 

Request an administrative reconsideration for employment assistance services and the Aim for employment program

A request for an administrative reconsideration can be submitted in one of the following ways:    

Send an application related to the employment assistance services and the Aim for Employment Program

Request the administrative reconsideration of a decision related to a vocational qualification

You must submit your request for an administrative reconsideration by mail.

Receipt of a written decision following an application for reconsideration

A written decision will be sent to you following your application. You will receive the decision within 30 calendar days.
