Judicial process
Consult a small claims file
You can make an informal application to the court in the course of a proceeding before the Small Claims Division. For example, it could be used to ask the court for access to a document or court record.
Fill out the form Application in the course of a proceeding (SJ-1268A) (PDF 277 Kb) to do so.
Content of the file
Files generally contain:
- Small Claims Division forms (SJ-870E);
- Response forms to an action at the Small Claims Division (SJ-871E);
- pleadings;
- evidence;
- court office letters to the parties;
- hearing minutes;
- judgments.
Content that cannot be consulted
The files may contain documents that cannot be consulted.
Some documents may be under sealed envelope, meaning they can be consulted only by persons who are authorized by law or by a judge.
Some documents may contain text that is hidden (redacted).
Finally, litigation cases involving the sharing of intimate images cannot be consulted, except in certain circumstances.
Copies of documents on file
You can request a copy of a document on file at the courthouse.
You can also take photos of documents on file at the courthouse.
However, you cannot leave the courthouse with any of the documents. In other words, the entire file must remain at the courthouse.
