Assistance Measure
The Curateur public’s role and responsibilities in the assistance measure
In addition to recognizing an assistant to a person of full age, the Curateur public has several other responsibilities.
Preventing situations that could harm the person
To prevent situations of abuse, the Curateur public makes sure to:
- conduct a criminal background check on the prospective assistant;
- send a copy of the application for recognition to at least two people close to person seeking assistance;
- meet with the person seeking assistance (the meeting can involve a lawyer/notary);
- meet with the person seeking assistance and the prospective assistant (the meeting can involve a lawyer/notary);
- receive the prospective assistant’s written agreement to respect the privacy of the person seeking assistance;
- use its investigative powers when deemed necessary, for example, if it receives a report regarding the actions of a recognized assistant;
- remove the assistant’s name from the Public register of assistants at the end of the assistance measure.
Processing of reports by the Curateur public
Filing a report essentially involves notifying the Curateur public of a situation that could pose a threat to the safety and physical or mental well-being of an assisted person or cause damage or harm to their property.
