Renewing the assistance measure

The maximum duration of an assistance measure is three years. If you would like to extend the assistance measure for another three years, you must submit an application for renewal.

At that time, you may choose to: 

  • have the same one or two people recognized as assistants;
  • keep the same person and add a second one; or
  • replace one or both people with new assistants.

The renewal process allows for a periodic review of whether the assistance measure is still appropriate and safe for the assisted person, based on their evolving situation. It ensures that the person can still express their wishes and preferences, and that the assistance measure continues to meet their needs. It also confirms whether there is any risk of harm if the proposed assistants are recognized. As with the initial application for recognition, the assisted person’s loved ones will be notified (and may oppose the application), judicial record checks will be conducted on the proposed assistants, and an interview will be held.

When to renew your assistance measure

Around 90 days before your assistance measure expires, the Curateur public will send you a notice inviting you to submit your application for renewal as soon as possible. This helps avoid a gap between your current measure and the new one. Processing an application may take up to 60 days, so it is important to submit all required information and documents in a timely manner.

When the new measure takes effect

Your new assistance measure will only take effect once the previous one expires, provided your assistant(s) are recognized by the Curateur public during the renewal process. Where applicable, a new assistance measure number will be assigned to you, and the relevant information will be entered in the Public register of assistants. A card attesting to the new recognition granted, and replacing the previous one, will be sent to your assistant(s). From that point on, you will need to give your new assistance measure number to service providers.

Renewing with a pre-filled form

You can renew your assistance measure online using a pre-filled form:

  • within 90 days before the measure ends; or
  • within six months after it has expired.

After six months, you will no longer be able to use the pre-filled form. You will need to submit a regular application.
