Accompaniment for developers

The government firmly intends to encourage companies that do business in Québec to maintain good relations with Indigenous communities and to take their concerns into account throughout the entire process of carrying out their initiatives.

To facilitate these relations, several Québec government departments and organizations, as well as certain institutions that play a role in deploying initiatives on the territory, have developed guides and policies and made them public. These documents are intended to build the awareness of businesses in the area of relations with Indigenous peoples and provide information on the rights of these peoples, and on how to take them into account.

Interim Guide for Consulting the Indigenous Communities

In the appropriate context, the Gouvernement du Québec may conclude agreements on matters of interest with an Indigenous community or nation. In recent years, it has concluded a consultation and accommodation agreement (PDF 264 Kb) with the community of Pikogan and a Québec-Mi'gmaq agreement on the process governing consultation and accommodation in respect of hydrocarbon activities (PDF 2.40 Mb). This agreement explains the main parameters governing the obligation to consult the Indigenous communities.

Best Practices Guide for Monitoring Committees and Legal Obligations of Mining and Petroleum Projects Promoters

The Mining Act and the Petroleum Resources Act require promoters to set up a monitoring committee throughout the operation of the projects. This committee must include a representative from one or more Indigenous communities. The above guide sets out the best practices and obligations connected with these monitoring committees.

Guide for public consultations conducted by the promoters of certain mining projects

This guide assists promoters in complying with their obligations under sections 101.0.1 and 140.1 of the Mining Act. These sections require the promoter to conduct public consultations on the project, during which they must, among other things, be sure to take note of the concerns of Indigenous communities.

Native Community Consultation Policy Specific to the Mining Sector

This policy has been developed in accordance with section 2.3 of the Mining Act, which provides for it to be adopted, disseminated and updated. It more specifically describes how to conduct consultations with Indigenous communities in the context of mining operations.
