Reciprocal enforcement of a support order following a Canadian divorce

To file an application linked to a Canadian divorce support order from another Canadian province or territory, you must meet all of the following conditions:

  1. You reside in a Canadian province or territory other than Québec.*
  2. You have obtained a divorce ruling from a court in Canada.
  3. Your former spouse resides in Québec.
  4. You wish to obtain, vary, rescind or suspend a support order for you or your child, or you wish to discontinue such an application.

* You may also file an application if you live in one of the following 10 U.S. states: California, Florida, Maine, Massachusetts, New Hampshire, New Jersey, New York, Oregon, Pennsylvania or Vermont.

Examples

Daniel lives in Ontario. He wants to change the amount set out in his divorce agreement with Sylvie, which says he must pay support to his children living in Québec. He should use the resources on this page.

Jane, a resident of Québec, wants to change the amount of support paid to her by Alex, her ex-husband, who lives in Alberta. She should not use the resources on this page. Instead, she should contact the Alberta government to find out what steps she needs to take.

Roger lives in Québec. He wants to change the amount of child support he must pay to his children, who live in Québec, following his divorce from Esther. Roger should not use the resources on this page. Instead, he should look into the procedures for child support in Québec.

Discontinuance

Fill out the form Discontinuance (DOCX 24 Kb) to discontinue an application for a support order or an application to vary, rescind or suspend a support order.
