Loss of the benefit of the protection of voluntary deposit in the event of bankruptcy

If you declare personal bankruptcy and have the benefit of voluntary deposit, the notice of stay of the trustee in bankruptcy will not cause your file to be closed. Only a decision to waive the benefit of voluntary deposit, or the payment of all your registered debts, allows the closure of your file.

To close your voluntary deposit file after declaring bankruptcy, you must either:

  • file a written decision to waive the benefit of voluntary deposit with the clerk, or;
  • pay your debts.
