Death of the debtor

Following the death of a person registered for voluntary deposit, the person’s succession must present the original death certificate at the office of the Court of Québec where the voluntary deposit file was opened.

The death certificate may be presented in person or by mail. If the succession wishes to keep the original death certificate, it can ask the clerk to make a copy.

Once the death certificate has been received by the clerk, the deceased’s voluntary deposit file is closed.

However, the succession is not relieved of the deceased person’s debts, and remains responsible for communicating with the creditors and paying off the debts. A creditor may also contact or sue the succession.
